THIS MATTER is in respect of an Appeal by the City of Brampton (“City”) with respect to an application for a minor variance regarding the lands municipally known as 82 Bartley Bull Parkway and a dispute that has arisen between the Parties concerning documentary production prior to the hearing of the Appeal now scheduled to commence on February 10, 2024 (“Hearing”);
THE TRIBUNAL having reviewed and fully considered the materials filed by the Parties in respect of a motion by the City seeking to prohibit the Applicants from filing additional materials related to the Appeal prior to the Hearing, which include the Motion Record of the City dated December 31, 2024; the Book of Authorities of the City dated December 31, 2024; the Reply to Response to Motion of the City, dated January 13, 2025; Applicant’s Responding Motion Record received January 8, 2025; Affidavit of Sarabit Kang, sworn January 7, 2025; and the Document Book of the Respondents dated January 7, 2025;
AND THE TRIBUNAL having determined that pursuant to Rules 1.3, 1.5, 1.6, and 1.7 of the Rules of Practice and Procedure of the Ontario Land Tribunal (“OLT Rules”) that the Orders made below will provide the best opportunity for a fair, just, expeditious and cost-effective resolution of the merits of the Appeal;
THE TRIBUNAL ORDERS THAT:
(a) The hearing of the appeal by the City of Brampton (“Hearing”) shall be rescheduled from February 10, 2025, to commence on Thursday & Friday April 10th – 11th, 2025 for a period of two days;

(b) All materials that the Parties intend to rely upon at the Hearing shall be served and filed with the Tribunal by no later than March 1, 2025;
(c) For greater certainty, the Tribunal shall not accept from either Party any materials attempted to be filed after March 1, 2025 except where prior leave to do so has been granted by the Tribunal pursuant to a written motion brought in compliance with Rule 10.3 of the OLT Rules by no later than February 17, 2025; and
(d) The Hearing dates scheduled under paragraph 1 of this Order shall be peremptory and no further adjournments shall be granted.
