Order
THESE MATTERS having come on for a settlement hearing before the Ontario Land Tribunal (the "Tribunal") on June 12, 2024 ("Settlement Hearing");
AND THE TRIBUNAL having been satisfied by the uncontested planning evidence of Kate Cooper contained in an Affidavit sworn on June 10, 2024 and presented orally at the Settlement Hearing;
AND THE TRIBUNAL having issued an Interim Order on July 4, 2024 ("Interim Order") dismissing the appeal by United Parcel Service Canada Ltd. ("UPS") filed pursuant to section 17(36) of the Planning Act, R.S.O. 1990, c.P.13, as amended ("Act"), and allowing the appeals by UPS filed pursuant to section 34(19) of the Act in part by approving the Zoning By-law Amendments attached as Attachments 1 and 2 to the Interim Order in principle subject to the satisfaction of the precondition described in paragraph 9(e) of the Interim Order;
AND THE TRIBUNAL having been advised on February 28, 2025 by the City of Vaughan on consent of the parties that the precondition to the issuance of a Final Order in this matter listed in paragraph 9(e) of its Interim Order has now been satisfied;
THE TRIBUNAL THEREFORE MAKES AN ORDER THAT in accordance with the provisions of sections 17(46.1) and 34(26) of the Planning Act, R.S.O. 1990, c.P.13, as amended:
The appeal by United Parcel Service Canada Ltd. under subsection 17(36) is dismissed and Official Plan Amendment No. 99 for the City of Vaughan is approved;
The appeals by United Parcel Service Canada Ltd. under subsection 34(19) are allowed, in part; and,
The draft Zoning By-law Amendments attached hereto as Attachments 1 and 2 are approved.
