THESE APPEALS having come on for a public Settlement Hearing on April 2, 2024 and the Ontario Land Tribunal (the “Tribunal”) having heard opinion evidence in the area of land use planning that the appeals by Holland Hope General Partners Inc (the “Appellant”) under subsections 22(7), 34(11) and 41(12) should be allowed and that the planning instruments attached as Schedules A and B for the proposed development of the lands known municipally as Various Addresses (19349, 19357, 19365 and 19399 Yonge Street in East Gwillimbury be approved.
THE TRIBUNAL HEREBY ORDERS that:
The Appeal of the Official Plan Amendment (OLT-23-000445) is allowed and the Official Plan Amendment, attached as Schedule “A’ is hereby Approved.
The Appeal of the Zoning By-law Amendment (OLT-23-000446) is allowed and the Zoning By-law, attached as Schedule “B” is hereby approved.
The appeal of the Site Plan, (OLT-23-000447) is allowed and the draft site plan, with appropriate conditions, is approved in principle. The final order in appeal no. OLT-23- 000447 relating to the final form of the site-plan and conditions will follow upon confirmation from the Appellant and the Municipality that those instruments are in a final form or upon determination as to the final form of those instruments by the Tribunal should the parties be unable to agree to same.
In the event that there are any difficulties implementing any of the conditions of approval respecting removal of the Holding symbol (“H”) in the ZBA, or if any changes are required to be made the Tribunal may be spoken to.
