THIS MATTER, having come before the Tribunal arising from two proceedings brought for compensation pursuant to subsection 26(b) of the Expropriations Act, R.S.O. 1990, c. E.27, against the Ministry of Transportation (“MOT”) in respect of two nearby properties allegedly impacted by the same expropriation carried out by the MOT by their respective owners Metro Retail Centre Inc. and Ste-Marc Properties Inc., who have the same principals (“Owners”);
AND THE TRIBUNAL, having been advised that the Owners seek by written motion to have the Tribunal consolidate the two above-described proceedings pursuant to Rule 16 of the Tribunal’s Rules of Practice and Procedure (“Rule(s)”), and having been further advised that the MOT is in agreement with such consolidation;
AND THE TRIBUNAL, having reviewed the materials filed in connection with the written motion for consolidation and being in agreement that the requirements of Rule 16 have been satisfied;
THE TRIBUNAL ORDERS THAT the proceedings in OLT-24-000205 and OLT-24-000206 shall be consolidated for all purposes including any hearing that may be scheduled.
