INTRODUCTION
1This Merit Hearing was initially scheduled with respect to an appeal by the Applicant/Appellant under s. 45(12) of the Planning Act, R. S. O. 1990, c. P. 13, as amended regarding the Decision of the Committee of Adjustment of the City on refusal of a few variances related to the parking requirements for a 28-storey mixed-use building at the lands municipally known as 2093, 2097 and 2101 Old Lakeshore Road and 2096 and 2100 Lakeshore Road in the City. This hearing was converted to a Case Management Conference (“CMC”) based on the updates from the Parties regarding the status of the settlement for this matter.

2There is no issue with service of the Notice of this CMC, and so no further Notice is required.

3The Tribunal received no written request, nor did anyone attend seeking either Party or Participant status at this hearing.
MEDIATION AND SETTLEMENT
4The Tribunal was advised by the Parties in writing and at the hearing that a settlement had been reached in principle and the agreement was being prepared by the Parties. The Parties requested that the Tribunal schedule a one-day hearing to consider the settlement.
HEARING
5Upon request of the parties, the Tribunal set a one-day hearing from 10:00 am to 5:00 pm on Tuesday, March 11, 2025, in writing. The member is seized. No further Notice is required.
6Parties are asked to provide the settlement materials, including an affidavit in support of the proposal, draft instruments which the Tribunal is being asked to consider, and a draft Order, prior to the hearing in writing.

7THE TRIBUNAL ORDERS that the date and particulars of the hearing are set out above.
