MEMORANDUM OF ORAL DECISION DELIVERED BY A. Mason ON february 10, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The matter before the Tribunal is with respect to appeals filed by 1256384 B.C. Ltd. (North Stone) pursuant to s. 17(36) and s. 34(19) of the Planning Act, R.S.O. 1990, c. P.13, as amended, against the modified approval of an Application for an Official Plan Amendment and an Application to Amend the Zoning By-law by the City of Burlington, in respect of the lands known municipally as 1393 Graham’s Lane.
2This second case management conference (“CMC”) was held to provide an opportunity for the Tribunal to consider any status requests and to address the draft procedural order.
3No requests for Party or Participant status were received by the Tribunal.
4In advance of the CMC, the Tribunal received a draft Procedural Order (“PO”) for consideration and discussed same with the Parties. The Tribunal directed that a final PO be provided to the Case Coordinator by Tuesday, February 11, 2025. Prior to issuing this Decision, the final PO was received, is attached as Schedule 1 to this Decision and shall govern the proceedings.
5The Tribunal previously scheduled a five-day hearing for the consideration of the Merits of the Appeals from Monday, June 23, 2025, to Friday, June 27, 2025. Counsel advised that they were actively in settlement discussions and that the final number of hearing days may be shorter, or the matter may be resolved entirely.
ORDER
6THE TRIBUNAL ORDERS THAT the case management directives set out above are so ordered.
