THIS MATTER in respect of the lands municipally known in the City of Toronto as 707, 709 and 717 Church Street, 85, 89, 93 and 97 Collier Street, and 28 Park Road (the “Lands”) having come for a public hearing on July 7, 2022 before the Ontario Land Tribunal (the “Tribunal”) and the Tribunal having issued a Decision and Interim Order (the “Decision”) on July 19, 2022, allowing, in part, the appeal of the zoning by-law amendment application made by C & P Development Limited Partnership and approving the amendment of City of Toronto Zoning By-law 569-2013, in principle, with the Final Order withheld pending the completion of the conditions set out in the Decision;
THE TRIBUNAL having issued a Final Order on August 12, 2022, in which the Tribunal ordered that City of Toronto Zoning By-law 569-2013 be amended in accordance with the Zoning By-law Amendment attached to the Final Order and authorized the municipal clerk to format, as may be necessary, and assign a number to the Zoning By-Law Amendment for record keeping purposes;
AND THE TRIBUNAL having received a request, on consent of the Parties, pursuant to Section 23 of the Ontario Land Tribunal Act, 2021, S.O. 2021, c. 4, Sched. 6 and Rule 24.4 of the Tribunal’s Rules of Practice and Procedure to make a technical revision to Clause (O) of the above-noted Zoning By-law Amendment related to the use of the vehicle parking spaces permitted by the Zoning By-Law Amendment on the Lands to enable a maximum of three vehicle parking spaces to be used as resident parking spaces;
NOW THEREFORE
THE TRIBUNAL ORDERS that City of Toronto Zoning By-law 569-2013, as amended, is hereby amended in the manner as set out in Attachment “1” to this Order, with the municipal clerk authorized to format, as may be necessary, and assign a number to this by-law for record keeping purposes.
