MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON NOVEMBER 25, 2025 AND ORDER OF THE TRIBUNAL
1The matter before the Tribunal is the Appeal by Kevin Micheal (“Appellant”) against the decision of the City of Brampton Committee of Adjustment to deny a Minor Variance (“MV”) Application pursuant to ss. 45(12) of the Planning Act, for the property located at 4 Alderway Avenue.
2The Appellant is seeking to increase the maximum driveway width to accommodate parking for two proposed Additional Residential Units.
3This matter was the subject of s. 23 review and was scheduled for today as a Case Management Conference.
4The Appellant, who was self-represented in the original Hearing, retained a Legal Counsel and a Land Use planner for the re-hearing.
5The direction in the Disposition Letter was for the matter to be re-heard orally by a differently constituted panel of the Tribunal based on the materials already filed.
6However, given that it is a Hearing for a MV, it is a hearing de novo and the Appellant is allowed to submit new evidence.
7The Parties advised the Tribunal that they are ready to proceed as soon as possible and requested for the Hearing to be scheduled as soon as the Tribunal’s calendar would permit.
8The re-hearing was initially scheduled for December 10, 2025; however, an adjournment was subsequently sought/granted. The re-hearing is now scheduled for Wednesday, January 28, 2025.
9The Re-Hearing is scheduled to take place on Wednesday, January 28, 2026 at 10 a.m.
