THE TRIBUNAL having conducted a case management conference by telephone conference call on December 2, 2025 (“CMC”);
AND THE TRIBUNAL having requested counsel for the Parties to make written submissions subsequent to the CMC concerning the scheduling of a hearing under subsection 7(3) of the Expropriations Act, R.S.O. 1990, c. E.26 (“Act”);
AND THE TRIBUNAL having received and considered written submissions from counsel for the City of Kenora (“City”) dated December 12, 2025 and from the counsel for Adel Chidiac, Fadel Chidiac and Kenricia Properties Inc. (“Claimants”) received December 12, 2025, (collectively: “Submissions”);
AND THE TRIBUNAL having considered the arguments made by the Parties at the CMC and those set out in the Submissions and having reviewed and considered the provisions of section 6 and section 7 of the Expropriations Act;
THE TRIBUNAL ORDERS THAT:
The hearing contemplated by section 6 of the Act shall be held on February 11 and February 12, 2026, by videoconference pursuant to the following details:

The Parties shall deliver a Joint Book of Documents and a Joint Book of Witness Statements in PDF format by on or before February 2, 2026, both of which shall be bookmarked and shall include hyperlinks to all items listed in any table of contents contained within each Book;
The conduct and scope of the hearing described in 1 above shall be determined by the Tribunal Member presiding at the hearing; and
This Vice Chair shall remain seized in respect of any matters reasonably arising from the above Orders but shall not be seized in respect of the hearing described in 1 above.
