MEMORANDUM OF ORAL DECISION DELIVERED BY Gregory J. Ingram ON November 6, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the first Case Management Conference (“CMC”) with respect to 895 Lawrence’s appeals pursuant to subsection 22(7) and 34 (11) of the Planning Act, R.S.O. 1990, c.P.13, as amended (“Act”) due to a non-decision by the City regarding Official Plan and Zoning By-Law Amendment applications (together the “Applications”). The Applications seek to permit the redevelopment of 895 Lawrence Avenue East (“Subject Property”) by removing a two-storey building, currently used for a mix of commercial and other non-residential uses, and building three buildings with heights of 26, 32, and 34 storeys.
CMC
2At the onset of this CMC, the Parties provided an update to the Tribunal and indicated that they are continuing to work on narrowing the issues, had no objections to the Party and Participant Status requests, and requested that the Tribunal set a date for a second CMC.
3The Tribunal is satisfied that the Affidavit of Service provides satisfactory evidence, that proper notice of the CMC was provided, and no further notice is required. The Affidavit was signed by Renata Ribeiro on October 20, 2025, and it was marked as Exhibit 1.
STATUS REQUESTS
4The Don Mills Residents Inc. group was grated Party Status by the Tribunal based on their genuine interest in the redevelopment proposal and the planning related issues they raised related to building height and density, traffic circulation, visual safety hazards, and a potential loss of essential services. The Don Mills Residents Inc. indicated that it is their intention to call ‘fact based’ witnesses to assist the Tribunal in hearing this appeal.
5The Tribunal received 10 requests for Participant Status. The planning related issues raised, briefly summarized, are related to the following: height and density, massing, scale, impact on established character of the neighbourhood, design, safety, traffic safety, infrastructure capacity (healthcare, childcare, school), visual impact, lighting, and transition issues.
6The Tribunal granted Participant Status to the 10 applicants and informed them that these processes will be guided by a procedural order once one is received and approved by the Tribunal. Individuals granted Participant Status are the following:

NEXT STEPS
7Regarding Tribunal led mediation, the Parties indicated that they would continue discussions independently. The City confirmed a desire to learn more about the Applications in the coming months while the added Party indicated that they are open to participating in discussions.
8The Tribunal set Friday, February 6, 2026, for a second CMC to begin at 10 a.m. by video. The Parties were directed to submit a proposed agenda by Friday, January 23, 2026, which would include either a draft Procedural Order or a request to convert the CMC to hear a draft settlement proposal.
