Order
THIS MATTER in respect of the City of Waterloo’s Zoning By-law No. 2019-033 (the “By-law”), having come for a public hearing on February 4, 2020, before the Local Planning Appeal Tribunal (now the Ontario Land Tribunal; the “Tribunal”);
THE TRIBUNAL having issued a decision on February 20, 2020 (the “Decision”), ordering that pursuant to Section 34(31) of the Planning Act, R.S.O. 1990, c. P.13, as amended, the portions of the By-law which are not at issue on the appeal, as set out in the Decision, are in force and effect and are deemed to have come into force on the day the By-law was passed, namely, June 24, 2019;
AND THE TRIBUNAL further ordered that that the By-law is in full force and effect save and except the following provisions of the By-law as they apply on a site-specific basis to the lands which are the subject of the appeal of the By-law, namely:
- (a) Sections 3.P.2.4. (b), (e) and (h) as they apply to the lands known as 77 King Street North, Waterloo;
AND THE TRIBUNAL having now been advised by the City of Waterloo and the Appellant on December 15, 2025, that the Appellant has withdrawn their appeal;
NOW THEREFORE
THE TRIBUNAL ORDERS that all remaining provisions of the By-law that were subject to the site-specific appeal, namely (a) Sections 3.P.2.4. (b), (e) and (h) as they apply to the lands known as 77 King Street North, Waterloo, are in force and effect and are deemed to have come into force on the day the By-law was passed, namely, June 24, 2019.
