THESE MATTERS having come on for public hearing and after the hearing, the Ontario Municipal Board (the “Board”) in its Decision issued May 20, 2016 and Order issued on September 20, 2016 granted approval to the draft plan and draft plan conditions, and pursuant to subsection 51(56.1) of the Act, the final approval of this subdivision having been delegated to the City of Hamilton;
AND THE TRIBUNAL having received a request to approve a revised draft plan and revised draft plan conditions approved by the Board, and the Tribunal having received the consent of the parties, and after reviewing the request;
THE TRIBUNAL ORDERS that:
a) the draft plan of subdivision, approved by the Ontario Municipal Board (as it was then known) on September 20, 2016 is replaced by the Revised draft plan of subdivision (as set out in Attachment 1 to this Order (the “Draft Plan”)), and is subject to the Additional Special Conditions of Draft Plan Approval (as set out in Attachment 2 to this Order);
b) pursuant to subsection 51(56.1) of the Planning Act, the City of Hamilton shall have the authority to clear the conditions of draft plan approval and to administer final approval of the Draft Plan for the purposes of subsection 51(58) of the Act. If there are any difficulties in regard to the fulfillment of the conditions of draft plan approval, or if any changes are required to be made to the draft plan, the Tribunal may be spoken to; and
c) the approval of the Draft Plan shall lapse three (3) years following the fulfillment of the conditions of draft approval.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
