MEMORANDUM OF ORAL DECISION DELIVERED BY WILLIAM MIDDLETON ON NOVEMBER 26, 2025 AND ORDER OF THE TRIBUNAL
1This proceeding involves a claim for compensation made by the Claimant pursuant to subsection 26(1) of the Expropriations Act, R.S.O. 1990, c. E.26 (“Act”) arising from the expropriation by the MTO on or about December 7, 2018 in relation to the property municipally known as 539 Halter Road in the Town of Lindsay, Ontario (“Expropriation”).
2The Application and Statement of Claim by the Claimant was commenced on May 20, 2025 and the Reply of the MTO was delivered on November 25, 2025. A status conference was held by teleconference on November 26, 2025 at the direction of the Tribunal.
3Although this proceeding is at an early stage, the Expropriation took place almost 7 years ago. Thus, it is appropriate for this matter to be advanced from a case management perspective.
4The Parties agree that 5 days would be required for the hearing of this case in the event that a resolution cannot be reached through either negotiation or mediation. The Tribunal has scheduled the hearing commencing Monday November 23, 2026, at 10 am by Video Hearing for 5 days.

9Subsequent to the November 26, 2025 teleconference the Parties delivered a draft Procedural Order (“PO”) for the review and consideration of the Tribunal. A final PO has been issued as noted in the Orders made below.
ORDER
10THE TRIBUNAL ORDERS THAT:
(a) The Procedural Order appended as Attachment ‘A’ shall govern the conduct of this proceeding; and
(b) This Vice Chair shall be seized of any matters arising from this Decision and for the ongoing case management of this proceeding, including all motion practice, but shall not be seized in respect of the final hearing or of any mediation that may be convened.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
