THIS MATTER having come before the Tribunal where 300 Bayview Ave. Ltd. & 1405768 Ont. Ltd. (the “Appellants”) appealed the City of Toronto’s (the “City”) failure to approve plans or drawings submitted pursuant to subsection 114(5) of the City of Toronto Act, 2006, S.O. 2006, c. 11, Sched. A, as amended in respect of the above-referenced matter;
AND THE TRIBUNAL heard the above-referenced appeal and granted same, in part, pursuant to its interim decision and order dated June 8, 2022, subsequently corrected by notice to the Appellants and the City dated August 30, 2022 (collectively, the “Interim Decision and Order”);
AND THE TRIBUNAL in its Interim Decision and Order, at paragraph 73, directed the Appellants to fulfil certain conditions and revise certain plans or drawings submitted pursuant to subsection 114(5) of the of the City of Toronto Act, 2006, S.O. 2006, c. 11, Sched. A, as amended, to the satisfaction of particular City officials prior to the issuance of the Tribunal’s final order approving said submitted plans or drawings;
AND THE TRIBUNAL having received confirmation that the Appellants have fulfilled said certain conditions and revised said certain plans or drawings to the satisfaction of said particular City officials;
AND THE TRIBUNAL is in receipt of a list of plans and drawings, as contemplated by subsection 114(5) of the City of Toronto Act, 2006, S.O. 2006, c. 11, Sched. A, as amended, for approval;
THE TRIBUNAL ORDERS, in accordance with subsection 114(15) of City of Toronto Act, 2006, S.O. 2006, c. 11, Sched. A, as amended, that the plans and drawings attached hereto as Schedule “A” are hereby approved for the purposes of subsection 114(5) of City of Toronto Act, 2006, S.O. 2006, c. 11, Sched. A, as amended.
