THESE MATTERS having come on for a public hearing on July 25, 2022, and the Tribunal in its Decision issued August 23, 2022 having withheld its Final Order pending confirmation from counsel that the Town of Pelham has advised the Tribunal in writing that the requirements of Section “D” of the Minutes of Settlement has been satisfied;
AND THE TRIBUNAL having been advised by the Parties that the requirements of Section “D” of the Minutes of Settlement have been satisfied, including confirmation of odour control, final site plan and the contingency odour management plan;
THE TRIBUNAL ORDERS that the Zoning By-law Amendment containing the site-specific exceptions for the Redecan Site is approved. The Tribunal authorizes the municipal clerk to format, as may be necessary, and assign a number to the by-law for record keeping purposes.
