MEMORANDUM OF ORAL DECISION DELIVERED BY D. ARNOLD ON NOVEMBER 19, 2025 AND ORDER OF THE TRIBUNAL
1This fourth Case Management Conference (“CMC”) was held with respect to an appeal pursuant to subsection 41(12) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, (“Planning Act”) by Worldwide Properties (Alliston) Inc. (“Appellant”) pertaining to the failure of the Town of New Tecumseth (“Town”) to approve the plans or drawings required by section 41 of the Planning Act in connection with the proposed additional commercial and retail development on the lands municipally known as 17-37 Young Street in the Town of New Tecumseth within 60 days after receipt by the Town of such plans or drawings (“Appeal”).
2At the outset of the CMC, there was a request by counsel for the Appellant (Harold Elston) to be removed from the record as this counsel no longer represents the Appellant in this matter. The representative of the Appellant, Steve Doyle, was in attendance and had no concerns with this request nor did the Town and accordingly the Tribunal’s file in these proceedings will be updated to reflect that Harold Elston is no longer counsel for the Appellant.
3The Town advised that earlier this month technical studies including a traffic impact study were submitted by the Appellant to the Town and are currently under review. The Appellant requested that the Tribunal provide directions that would facilitate the proceedings before the Tribunal proceeding expeditiously.
4With the consensus of the Parties, the Tribunal directed as follows:
(a) The Town is directed to provide its comments on the Appellant’s submitted technical studies to the Appellant by no later than Monday, December 15, 2025;
(b) The Parties are directed to provide a draft Issues List to the Tribunal through the case co-ordinator for this matter by no later than Monday, February 2, 2026; and
(c) A fifth Case Management Conference is scheduled to take place on Tuesday, February 3, 2026 at 10 a.m. by video at which time the Tribunal will consider setting hearing date(s) and a draft Procedural Order including the draft Issues List submitted by the Parties. Details pertaining to this fifth Case Management Conference are provided below.

9The Tribunal encouraged the Parties to continue discussions with a view to settling some or all of the issues of the Appeal. The Tribunal advised that Parties that they may request consideration for Tribunal-facilitated mediation through the case co-ordinator.
10The Tribunal directs the Parties to provide the Tribunal (through the Case Coordinator) with any update with respect to this matter, including any request for the Tribunal’s approval to convert the fifth CMC to a settlement Hearing.
11The Tribunal orders and provides these CMC directives for the purposes of case management of the Appeal.
12The Member is not seized in this matter but will remain available for continued case management to the extent that the Tribunal calendar permits.
13No further notice is required nor will be given.
