MEMORANDUM OF ORAL DECISION DELIVERED BY D. CHIPMAN ON NOVEMBER 10, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The Tribunal convened a first Case Management Conference ("CMC") in respect of the Appeal filed by Concord Adex Inc. pursuant to s. 34(11) of the Planning Act ("Act"), on the City refusal on an application for a Zoning By-law Amendment ("ZBA"). The Subject Lands are municipally known as 699-707 Yonge Street, 1-17 Hayden Street and 8 Charles Street East in the City of Toronto.
2The purpose and effect of the ZBA application is to permit a 64-storey (217 metres, including mechanical penthouse) mixed-use building containing 514 dwelling units.
3The Tribunal received Affidavit of Service sworn by Rochelle Vasquez, dated August 8, 2025, confirming that Notice of this CMC was properly given and, as such, no further notice will be required. The Affidavit of Service was marked Exhibit 1 to this proceeding.
PARTY STATUS REQUESTS
4The Tribunal received and upon hearing no objections from the Parties granted Party Status to the following:
- EH 695 Yonge Street GP Inc.
- Yonge Charles Title Holdings Inc.
- EH 685 Yonge Street GP Inc.
- 685 Yonge Street Limited Partnership
5699 Yonge (Brass Rail Tavern (Toronto) Limited), and 8 Charles Street (1209623 Ontario Limited), are two of the properties comprising the lands subject to the above-noted application and the Tribunal appeal by Concord Adex.
6Andrew Porter, counsel for the Brass Rail Tavern (Toronto) Limited and 1209623 Ontario Limited indicated that the participation sought will not result in unnecessary duplication of evidence or otherwise delay the proceeding.
CMC HEARING
7The Appellant noted that an accompanying Ontario Heritage Act application was required by the City. The application was filed on November 6, 2025, and will be processed by the City and a request for consolidation with the appeal before the Tribunal will be discussed at the next CMC.
8All Parties agreed that April 2026, would be a suitable to hold a second CMC. This will allow additional time for discussions between the Parties and the completion of a draft Procedural Order and Issues List for discussion and consideration by the Tribunal.
MEDIATION
9The Tribunal noted that Tribunal-led mediation information can be obtained through the Case Coordinator.
SECOND CMC HEARING
10Accordingly, the Tribunal set a second CMC to commence on Monday, April 13, 2026, at 10 a.m. by video conference. Parties are directed to forward a draft Procedural Order inclusive of an Issues List to the Case Coordinator, 10 days in advance of the second CMC for discussion and approval by the Tribunal.
