MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON NOVEMBER 3, 2025 AND ORDER OF THE TRIBUNAL
1This was the second Case Management Conference (“CMC”) in the matter of appeals by FNF Enterprises Inc. (“Applicant” / “Appellant”) seeking the issuance of the by-law without the holding provision, pursuant to ss. 34(19) of the Planning Act, for the properties located at 229, 235, 239 and 247 Royal Oak Road in the City of Cambridge.
2The Appellant is seeking to permit two industrial warehouse buildings.
CMC, PROCEDURAL ORDER AND ISSUES LIST
3The Tribunal was advised by the Parties that they are still having discussions regarding the Issues List (“IL”). The Parties requested additional time before providing the Tribunal with the Draft Procedural Order (“DPO”) and IL.
4The DPO and IL are due on or before Monday, January 12, 2026.
5In addition, the Parties have requested a third CMC to be scheduled in February of 2026 and a four-day hearing to take place in May of 2026.
6The Tribunal directed the Parties to contact the assigned case-coordinator in advance, if the third CMC is not required.
7The third CMC is scheduled to take place by video on Thursday, February 5, 2026 at 10 a.m.
8A four-day Hearing is scheduled to proceed by video and commence on Monday, May 25, 2026, at 10 a.m. and continue through Thursday, May 28, 2026.
