THIS MATTER, in respect of the property at 875 The Queensway (“Subject Property”) having come before the Ontario Land Tribunal (“Tribunal”) for a settlement hearing on October 12, 2022;
AND the Tribunal in its Oral Decision on October 12, 2022 and in its written decision, issued on December 21, 2022, having allowed the appeal, in part, and approved the Zoning By-law Amendment, in principle;
AND THE TRIBUNAL having withheld its Final Order regarding the Zoning By-law Amendment, pending the satisfaction of certain pre-requisite matters;
AND THE TRIBUNAL having been advised by letter, dated October 24, 2025, that ownership of the Subject Property has been transferred from Format Queensway Inc. to 875 The Queensway Ltd. The Tribunal notes no objection by the City of Toronto (“City”) to the change of ownership. Pursuant to Rule 8.2 of the Tribunal Rules of Practice and Procedure, the Tribunal finds it reasonable to, and therefore now substitutes 875 The Queensway Ltd. as a Party to this appeal; AND THE TRIBUNAL having received written confirmation from the City Solicitor that the pre-requisite matters, as described in paragraph 25 of the Interim Order, have now been satisfied, including confirmation of the final form of the Zoning By-law Amendment;
The Tribunal orders that Zoning By-law No. 569-2013, as amended, is hereby amended in the manner set out in Schedule “A” to this Final Order. The Tribunal authorizes the municipal clerk to format, as may be necessary, and assign a number to this by-law for record keeping purposes.
The Tribunal may be spoken to in the event any matter arises in connection with the implementation of this Order.
