MEMORANDUM OF ORAL DECISION DELIVERED ON NOVEMBER 12, 2025, BY S. DEBOER AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This Decision arises from the first Case Management Conference (“CMC”) held in preparation for the appeals by TACC HOLBORN (Block 140) Inc. (“Appellant”) pursuant to s. 22(7) and 34(11) of the Planning Act due to the City of Brampton’s (“City”) failure to make a decision on the Official Plan Amendment (“OPA”) and Zoning By-law Amendment (“ZBA”) Applications for the property municipally known as Block 140 of Plan 43M2092 in the City of Brampton (“Subject Lands”).
2The purpose of the CMC was to consider requests for Party or Participant status and to set a date for the next hearing events.
AFFIDAVIT OF SERVICE
3At the commencement of the hearing, the Tribunal reviewed, approved and marked the Affidavit of Service by Christopher J. Drew dated October 28, 2025, as Exhibit 1 to the hearing. Since the Tribunal was satisfied with the Affidavit of Service, the Tribunal ruled that no further Notice would be necessary.
BACKGROUND
4The purpose of the applications is to permit the development of a mixed-use high-density development consisting of four buildings with seven high-rise mixed-use towers, ranging in height from 23 to 43 storeys. The applications propose to permit a total of 2,461 residential units, with 123 of the proposed units being considered as affordable housing units.
5The Appellant notified the Tribunal that there is a Minister Zoning Order (“MZO”) on the Subject Lands, however, an OPA and ZBA is still required for the further permissions that are being asked for by the Applicant.
6The Appellant also notified the Tribunal that there is a Draft Plan of Subdivision Application (“DPS”) before the City. The Appellant stated that it is anticipated that the City will not make a decision on the DPS within the statutory timelines, and the Appellant will file a further appeal with the Tribunal concerning the DPS in late January 2026. The Appellant then stated that it would be the request of the Appellant to have all the Applications heard together.
STATUS REQUESTS
7The Tribunal did not receive any requests for Party status; however, the Region of Peel (“Region”) did attend the hearing event as an observer only. As an Issue List was not been circulated prior to the CMC, the Region will maintain its observer status unless there are issues that are raised that are directly related to the Region’s responsibilities. If that occurs, then the Region would request make a request of the Tribunal to grant the Region Party status.
8Prior to the hearing, the Tribunal received a Participant request from Rakesh Brahmbhatt, dated November 5, 2025. After review with the Parties, the Tribunal accepted the Participant Statement of Mr. Brahmbhatt, and this statement will be used as apart of the final determination of the planning instruments before the Tribunal.
OPPORTUNITIES FOR RESOLUTION
9The Tribunal discussed Tribunal-led mediation with the Parties. As all of the potential planning instruments are not before the Tribunal at this time, the Parties felt that there was not a need for Tribunal-led mediation at this time. The Parties agreed that if there was a need for mediation after a Procedural Order and Issues List had been finalized, it would contact the Tribunal to request Tribunal-led mediation.
SCHEDULING OF HEARINGS
10As a result of the discussions between the Parties and the Tribunal, the Tribunal determined that a second CMC would be necessary to review and approve a Procedural Order and Issues List.
11The Tribunal has scheduled a second CMC to occur on Wednesday, April 8, 2026, at 10 a.m., by Video Conference. It is the intent of this CMC to finalize a Procedural Order and Issues List. The Tribunal directs the Parties to submit a Procedural Order and Issues List no later than Thursday, April 2, 2026, for the Tribunal’s review prior to the CMC.
12The Parties had requested that a 3-week hearing be scheduled by the Tribunal in October 2026. As there is sufficient time between the second CMC and the requested 3-week hearing, the Tribunal found that it would be prudent to schedule a hearing as requested.
13As such, the Tribunal has scheduled a 14-day hearing to occur, commencing on Tuesday, October 20, 2026, at 10 a.m., by video conference, for a period of 14 days.

15Parties and Participants are asked to log in to the event at least 15 minutes before it begins to test their video and audio connections.
