THESE MATTERS, having come on for a public hearing on October 24, 2023 before Member Steven T. Mastoras and the Ontario Land Tribunal (the “Tribunal”) determined that the appeal(s) under subsection 22(7) of the Planning Act (the “Official Plan Amendment Appeal”) and subsection 34(11) of the Planning Act (the “Zoning Appeal”) should be allowed, in part, and should be approved, in principle, with the final Order withheld pending the Tribunal being advised by the City Solicitor that such conditions in Paragraph 14 of the Tribunal’s Decision have been fulfilled;
THE TRIBUNAL HAVING BEEN ADVISED that these above-noted matters have been completed to the satisfaction of the City of Toronto prior to the issuance of a final Order regarding the Official Plan Amendment Appeal and Zoning Appeal have been satisfied, including the final content and form of the proposed Official Plan Amendment and proposed Zoning By-law Amendment;
THE TRIBUNAL ORDERS that the Official Plan Amendment Appeal and the Zoning Appeal are allowed, in part, and that the City of Toronto’s Official Plan is hereby amended in the manner set out in Attachment “1” to this Order and the Zoning By-law No. 569-2013 of the City of Toronto, as amended, is hereby amended in the manner set out in Attachment “2” to this Order.
AND THE TRIBUNAL ORDERS the municipal clerk is authorized to format the by-law in Attachment “1” and Attachment "2", as may be necessary, for record keeping purposes.
