Order
THIS MATTER having come before the Tribunal;
AND THE TRIBUNAL having issued an Order on October 3, 2025 to allow the appeal and the application to remove the heritage designation for the property located at 41 Bayfield Main Street South (the “Subject Property”) is not authorized upon being advised that David and Jane MacLaren (the “Applicant”) does not wish to proceed with this application;
AND THE TRIBUNAL having been advised by the applicant after issuing the Order that it was the applicant’s intention to adjourn the hearing of the application as opposed to having the application dismissed;
AND THE TRIBUNAL having been advised by the new owners of the subject property that they fully support the repeal heritage designation and would therefore want the opportunity to appear before the Tribunal to support their position and provide information on the future use of the subject property;
THE TRIBUNAL ORDERS that upon its powers under Section 23 of the Ontario Land Tribunal Act, 2021, S.O. 2021, c.4, Sched. 6 (the “OLT Act”), the Order issued on October 3, 2025 is hereby rescinded and the case is now reopened for the purpose of offering the best opportunity for a fair, just, expeditious and cost-effective resolution of the merits of the proceeding in accordance with Rule 1.4 of the Tribunal’s Rules of Practice and Procedure as exercised by its powers under the OLT Act.
