MEMORANDUM OF ORAL DECISION DELIVERED BY S. BRAUN ON OCTOBER 22, 2025 AND ORDER OF THE TRIBUNAL
1This was the second Case Management Conference (“CMC”) held for the purpose of organizing appeals by 2631622 Ontario Corp. (“Appellant”) against the adoption of By-law No. 174-2024 by the City of Vaughan (“City”) and of the City’s failure to make a decision on an application for an Official Plan Amendment and temporary Zoning By-law Amendment in relation to the property located at 11151 Highway 50. These matters were previously ordered to be heard together pursuant to Rule 16.1 of the Tribunal’s Rules of Practice and Procedure.
2Prior to the CMC, the Parties submitted a draft Procedural Order (“PO”) and a detailed Issues List (“IL”). The Tribunal reviewed same with the Parties and directed specific revisions in instances where the PO differed from the Tribunal’s standard PO for Video Hearings. The Parties were also directed to revise an issue that was improperly vague and provided guidance to assist the Parties in tying the issue to specific policies in an effort to properly focus the evidence at a future hearing. Counsel for the City agreed to revise, circulate for consent and submit a finalized draft PO and IL to the Tribunal no later than noon on Monday, November 3, 2025.
3On the strength of the detail provided in the draft IL, discussions with the Parties regarding the number of witnesses anticipated to be called and, most importantly, Counsel for the City’s undertaking to submit a revised draft by the agreed upon deadline, the Tribunal granted the Parties’ request to schedule a five-day Video Hearing, which will commence on Monday, March 9, 2026 at 10:00 a.m.
4Should the Tribunal not receive the finalized draft PO and IL (or a request for an extension) by the deadline specified in paragraph [2] above, the scheduled hearing dates will be removed from the Tribunal’s calendar and the Parties will be required to attend a Telephone Conference Call (“TCC”) to provide an update to the Tribunal and discuss the possibility of rescheduling the Hearing.

Questions prior to the Hearing event may be directed to the Tribunal’s Case Coordinator having carriage of this case.
9The Parties are reminded of the availability of Tribunal-assisted mediation and of the expectation that they are to cooperate to reduce the length of the Hearing by eliminating redundant evidence and attempting to reach settlements on issues where possible.

11There will be no further Notice, and this Member is not seized but may be available for case management should the Tribunal’s calendar permit.
