MEMORANDUM OF ORAL DECISION DELIVERED BY Yasana Faghani ON October 17, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This event was the second Case Management Conference (“CMC”) before the Tribunal with respect to appeals under section 17(36) of the Planning Act by three appellants: Frank Renz, Gino Iacoucci, and Lilacpark Inc. with respect to the new Official Plan for the Township of Clearview (“Township”), which was passed by the Township on May 27, 2024, and approved by the County of Simcoe (“County”) on November 26, 2024.
STATUS UPDATE
2As detailed in the first CMC Order, the Town’s Counsel advised that the three appeals are very site-specific and can be dealt with separately from each other. Prior to this CMC, one of the Appellants advised the Tribunal that it had reached an agreement with the Township to resolve its appeal as will be discussed below. Counsel for the remaining two Appellants advised that there has been continued settlement discussion, and the recommendation was for the scheduling of a further CMC. Counsels for the County and Town agreed with this approach.
3The Appellants advised as follows:
a. Lilacpark Inc.: Counsel advised that a settlement had been reached in principle and the parties were in the process of finalizing their settlement documents. As such, the parties requested a written hearing to consider the Parties’ settlement proposal. After some discussion, the Tribunal granted the request with the hearing scheduled to proceed on November 13, 2025.
b. Frank Renz: Counsel explained that the parties are continuing discussions with respect to a technical issue which has been addressed via engineering reports. The reports have been received, and it is a matter of determining next steps. As such, counsel requested a further CMC date so as to provide the Tribunal with a status update and to determine at that point if a Hearing is warranted. There was no opposition to this request from any other party. Furthermore, Counsel for the Appellant advised that the related Zoning By-law Amendment (“ZBA”), OLT Case No. OLT-22-004062, did not proceed with the scheduled CMC on April 15, 2025. Counsel requested if the Tribunal can schedule the CMC on the ZBA to proceed on the same date of the third CMC that is to be scheduled on this appeal. The Tribunal advised that since the ZBA is not currently before it, it is unable to grant requests on that matter. However, the Tribunal advised that Counsel may follow up with the case coordinator on the ZBA and request that a further CMC be scheduled at the same time as the third CMC for this appeal. If so, matters related to both the ZBA and this appeal can be heard at the same time, including the potential consolidation of the two matters.
c. Gino Iacoucci: Counsel explained that there is an approved draft plan before the Township, but that the mapping does not recognize it. There have been discussions with the Township planner and this matter may resolve without the need of a hearing. With that said, a further CMC was requested so as to provide an update to the Tribunal.
4All Parties agreed that by the New Year, 2026, they would have a clearer idea of where things stood. The Tribunal accepted this approach and granted the Parties’ request schedule a third CMC in 2026 with details provided below.
5The Parties were directed to provide a draft Procedure Order, including an Issues List, or a status update to the Tribunal by in advance of the third CMC.
MEDIATION AND SETTLEMENT
6As explained above, due to the nature of this appeal in relation to related matters, the Parties are in discussions with each other. The Parties also advised they are aware of Tribunal-assisted mediation. The Parties were directed to advise the Tribunal in writing should they reach a Settlement with respect to some or all of the issues.
FURTHER DATES
7As discussed above, a written hearing to consider the Parties’ settlement proposal is scheduled to proceed on the Lilacpark Inc. matter on Thursday, November 13, 2025.
8A third CMC has been scheduled to take place by video conference on Wednesday, January 14, 2026 at 10 a.m.

13THE TRIBUNAL ORDERS as follows:
a. A written settlement hearing for the Lilacpark Inc. matter is scheduled as described above in this Decision.
b. A third Case Management Conference is scheduled as described above in this Decision.
