MEMORANDUM OF ORAL DECISION DELIVERED BY SHARON L. DIONNE ON OCTOBER 17, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the Tribunal’s Decision and Order stemming from a first Case Management Conference (“CMC”) on the appeals filed by Park River Management Inc. in respect of the non-decision of the City of Ottawa on a Site Plan Application within the timeframe(s) prescribed under the Planning Act, R.S.O. 1990, c. P 13, as amended (“Act”).
2The Application seeks approval to permit three-storey Back-to-back Townhomes (94 Units), with provision to add Accessory Dwelling Units, on the lands municipally known as 200 Baribeau Street, Ottawa.
3The Tribunal is satisfied that proper notice of this CMC was given, and that no further notice is required. The Tribunal confirms that no requests for Party or Participant status were received.
POTENTIAL FOR SETTLEMENT
4The Parties advised the Tribunal that the discussions between them have been productive, and that a recent Zoning By-law Amendment passed by the City is now in effect which resolves certain issues on the Application. As a result, there is only one remaining issue, pertaining to parkland, and that discussions on this are still on-going.
5The Parties agreed that whether there will be a resolution on the remaining issue or not will be determined soon, and that the Parties would be able to advise the Tribunal by October 29, 2025.
6The Parties agreed on procedural matters and were seeking the scheduling of a second CMC for a date in mid-November 2025, by which time if there is still an issue remaining, they will be asking the Tribunal to schedule a hearing on the one remaining issue. Alternatively, if they settle by then, the Parties would be seeking the Tribunal’s approval to convert the date of the second CMC to hear the settlement.

7A second CMC is scheduled for Tuesday, November 18, 2025, at 10 a.m., by video conference.

11The Tribunal directs the Parties to provide a status update advising whether a settlement has been reached or not, in writing, by no later than October 29, 2025.
12If the Parties have not reached a settlement on the remaining issue, the Tribunal directs the Parties to prepare a draft Procedural Order and Issues List to be considered at the time of the second CMC, and to submit same by no later Monday, November 10, 2025.
13If the Parties reach a settlement and are seeking the conversion of the second CMC date to hear the settlement, the Tribunal directs the Parties to submit the required documentation, such as a Planner’s Witness Statement and/or an Affidavit along with the draft planning instrument(s), for the Tribunal’s consideration, and not later than 10 days prior to the settlement hearing date.
ORDER
14THE TRIBUNAL ORDERS the above directives.
15The Member is not seized but may be available to assist with the case management of this proceeding, subject to the Tribunal’s calendar.
