MEMORANDUM OF ORAL DECISION DELIVERED BY T.F. NG ON OCTOBER 20, 2025 AND ORDER OF THE TRIBUNAL
1This is the second Case Management Conference (“CMC”) for the above-noted matter. 1057100 Ontario Limited (“Appellant”) has filed appeals against the City of Toronto’s (“City”) failure to make a decision within the statutory time frames for the Appellant’s application to permit a mixed-use development of three residential towers with office and retail space with respect to the properties 2-4 and 80 Union Street, Toronto. The appeals were pursuant to s. 22(7) and s. 34(11) of the Planning Act (“Act”).
DRAFT PROCEDURAL ORDER
2Counsel informed the Tribunal that the draft Procedural Order (“PO”) with Issues List has been filed and Mr. Cole requested a ten (10)-day hearing to be scheduled. City counsel Mr. McKeich concurred. Counsel noted that the PO will require the deadlines to be filled in and some non-substantive revisions.
MEDIATION
3The Parties will carry out private discussions, have no instructions on mediation but will be open to it once the hearing is scheduled.
DISPOSITION
4The Tribunal will schedule a ten (10)-day hearing as requested. There will be no further notice, and the Member is not seized. In the event that the matter is resolved, parties to notify the Tribunal to release hearing dates at least 30 days before the hearing scheduled.

5The Hearing is scheduled to proceed by video on Monday, July 13, 2026 to Friday, July 24, 2026 at 10 a.m.
