THESE MATTERS having come before the Ontario Land Tribunal (the “Tribunal”) at a Settlement Hearing on March 14, 2023 regarding the settlement for the lands at 200 Wellington Street West (the “Subject Lands”), and the Tribunal having issued an Interim Order dated April 14, 2024 having determined that the appeals under Sections 22(7), 34(11), and 41(12) of the Planning Act, R.S.O. 1990, c. P.13, as amended, relating to the Subject Lands should be allowed in part and approving the Official Plan Amendment and the Zoning By-law Amendment in principle as it relates to the Subject Lands, but withholding its final order until advised by the parties that an agreement has been reached on the Site Plan Approval; and
AND THE TRIBUNAL having been advised by the parties that an agreement has been reached on the Site Plan Approval;
THE TRIBUNAL HEREBY ORDERS THAT:
- The Official Plan Amendment (OLT-22-004060) attached as Attachment 1 to this Order is approved;
- The Zoning By-law Amendment (OLT-22-004061) attached as Attachment 2 to this Order is approved;
- The Conditions of Site Plan Approval (OLT-22-004809) attached as Attachment 3 to this Order is approved;
- The municipal clerk is authorized to format, as may be necessary, and assign a number to the Official Plan Amendment, as shown in Attachment 1 to this Order, and the Zoning By-law Amendment, as shown in Attachment 2 to this Order, for record keeping purposes; and
- The Tribunal may be spoken to in the event that the parties have any difficulty in implementing this Order.
