THIS MATTER involving an appeal of the passing of Zoning By-law No. 1260-2024 to the City of Toronto, being a Bylaw to enact City-wide As-of-Right Zoning for Mid-Rise buildings on Avenues and Updated Rear Transition Performance Standards, by Canadian Tire Corporation Limited (“Appellant”) pursuant to s.34(19) of the Planning Act, R.S.O.1990, c. P.13, as amended;
AND THIS MATTER having previously come before the Tribunal, differently constituted, at Case Management Conference on May 1, 2025, at which time there were no requests made for Party or Participant status;
AND THIS MATTER having come before the Tribunal at a Case Management Conference on October 23, 2025, at which time the Tribunal was advised that the Parties have been having on-going discussions and negotiations towards a possible settlement of the appeal;
AND UPON A MOTION brought, on October 23, 2025, by the City for the scoping and partial approval of Bylaw No. 1260-2024, on consent of the Appellant;
AND THE TRIBUNAL, having reviewed and considered materials in support of the Motion, including the sworn affidavit evidence of Viktoriya Slobodyan, Legal Assistant with the City of Toronto dated October 8, 2025, and the submissions of the Parties before it in respect of the Appellant’s appeal being the only appeal in respect of the Bylaw, grants the Motion to scope the appeal geographically to 2850 Kingston Road, in the City of Toronto, as set out in the materials referred to herein.
THE TRIBUNAL ORDERS THAT:
- The scope of the appeal of Zoning By-law No. 1260-2024 to the City of Toronto is as follows:
a. Geographic Scope: 2850 Kingston Road.
In accordance with subsection 34(31) of the Planning Act, R.S.O. 1990, c. P.13, as amended, Zoning By-law No. 1260-2024 shall be deemed to have come into force on the day it was passed, being November 14, 2024, for all areas of the City set out in sections 34 and 35 of Bylaw No. 1260-2024, save and except for the lands municipally known as 2850 Kingston Road as delineated in Attachment “A” to this Order.
The Parties are to provide the Tribunal with an update as to the status of the appeal, in writing, by no later than April 17, 2026.
This Member remains available to assist with the case management of this proceeding, subject to the Tribunal’s calendar.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
