ORDER
BEFORE: “T.F. Ng” VICE-Chair
Wednesday, the 15th day of October, 2025
WHEREAS THE TRIBUNAL having issued its Decision in OLT-22-002301 on September 19, 2022, following a settlement hearing, amended Zoning By-law 2010-040 and approved the Draft Plan of Subdivision #D1201111 (the “Draft Plan”) subject to the fulfillment of conditions, including a condition that approval of the Draft Plan is for a period of three years (the “Lapsing Condition”), whereby the Draft Plan was scheduled to lapse on September 19, 2025;
AND THE TRIBUNAL having received a Notice of Appeal of the Lapsing Condition (and Note to Draft Approval no. 12) pursuant to subsection 51(43) of the Planning Act, seeking an extension of the Lapsing Condition to September 19, 2028;
AND THE TRIBUNAL having been informed that the Town of Collingwood’s Director of Growth and Development authorized the extension of the lapsing period to October 19, 2025, issued an Interim Order on September 3, 2025, extending the approval of the Draft Plan on an interim basis to October 19, 2025;
AND THE TRIBUNAL having received the Affidavit of Mr. Mark Yarranton (affirmed on September 16, 2025), supporting the extension of the approval of the Draft Plan for a period of three years;
AND THE TRIBUNAL having been informed that on October 6, 2025, Town Council ratified the following recommendation:
Recommendation:
THAT Report P2025-25, “Draft Plan of Subdivision Approval Extension Request – Huntingwood Trails West (5 Silver Creek Drive, Town File PLEDP2025232)”, dated October 6, 2025, be received;
AND THAT the Request for Extension of Draft Approval for the Plan of Subdivision – Huntingwood Trails West (PLEDP2025232), including minor technical amendments to the associated conditions of draft plan approval as appended to this Report, be approved for a period of three years with the expectation that the proponent will continue to progress expeditiously toward registration.
AND THE TRIBUNAL having been satisfied that extension of the approval of the Draft Plan is in the public interest and represents good planning;
THE TRIBUNAL ORDERS that approval of the Draft Plan is extended for a period of three years from September 19, 2025, and will lapse on September 19, 2028;
AND THE TRIBUNAL FURTHER ORDERS that Draft Plan conditions 26 and 69 and Note to Draft Approval 12 are hereby amended and replaced with the following:
Draft Plan Conditions
That prior to any site alteration or development at this location, required permits, under Ontario Regulation 41/24 and the Conservation Authorities Act, will be obtained from the Nottawasaga Valley Conservation Authority and any necessary authorization from the Department of Fisheries and Oceans for any harmful alteration, disruption or destruction of fish habitat.
Subject to the conditions set forth above, this Draft Plan is approved under Section 51 of the Planning Act, R.S.O 1990, Chapter 13, as amended, this 19th day of September, 2022. The approval of this Draft Plan, originally set to lapse on September 19, 2025, is extended for a period of three (3) years and will lapse on September 19, 2028.
Notes to Draft Approval
- The approval of this Draft Plan is extended for a period of three (3) years and will lapse on the 19th day of September, 2028.
AND THE TRIBUNAL FURTHER ORDERS that it may be spoken to in the event any matter or matters should arise in the connection with implementation of this Order.
