MEMORANDUM OF ORAL DECISION DELIVERED BY CARMINE TUCCI ON OCTOBER 3, 2025 AND ORDER OF THE TRIBUNAL
1The matter before the Ontario Land Tribunal (“Tribunal”) was with respect to the appeals of the non-decision of the City of Toronto regarding an application to amend the Zoning By-law.
2On July 31, 2021, the Applicant, represented by Bousfields Inc., submitted a Zoning By-law Amendment Application for the property at 189-195 Old Weston Road.
3City Council failed to make a decision within the statutory timeframe.
4The Zoning By-law Amendment Application seeks to modify the City’s existing Zoning By-law to allow for a mixed-use development. The proposed project includes an eight (8)-storey mid-rise building designated for non-residential use, an 11-storey residential mid-rise building, and a 27-storey residential tower. In total, the development would comprise 405 residential units and approximately 34,361 square metres of gross floor area, which includes 4,410 square metres allocated for non-residential purposes.
5The property is situated within the Keele-St. Clair Secondary Plan area, identified as Official Plan Amendment 537 (“OPA 537”). This amendment was adopted by City Council on July 22, 2022, and is currently awaiting approval from the Minister of Municipal Affairs and Housing under section 26 of the Planning Act. OPA 537 aims to establish a new secondary plan that supports the creation of a complete community around the future St. Clair – Old Weston GO Station. Under this plan, most of the property is expected to be redesignated from Core Employment Areas to Mixed Use Areas in the City’s Official Plan. Accordingly, the Applicant expects that the City will support allowing the appeal to proceed, with the understanding that if the Tribunal ultimately approves the Zoning By-law Amendment Application, a final Order would not be requested until OPA 537 receives ministerial approval.
6Before and after submitting the Zoning By-law Amendment Application, the Applicant has actively engaged with City staff and local stakeholders to address key objectives related to the proposal. The Applicant remains committed to continuing this collaborative approach, with the goal of resolving the appeal through constructive dialogue wherever possible.
7The purpose of the Case Management Conference (“CMC”) was to receive status updates from all Parties to organize the Hearing of these appeals.
8The Tribunal received an Affidavit of Service sworn by Robert Daniel Edward Jefferson and had it marked as Exhibit 1.
9The Tribunal heard the Parties are evaluating an opportunity for a possible settlement through mediation.
10Further, the Parties are seeking a ten (10) day Hearing.
