THIS MATTER involving an appeal pursuant to subsection 34(19) of the Planning Act, R. S. O. 1990, c. P. 13, as amended, regarding the appeal of decision of the City of Toronto Zoning By-law Amendment 849-2025 (“ZBA 849-2025”) to improve the implementation of garden suites and to align zoning permissions for garden suites, laneway suites and multiplexes with recent provincial regulatory changes (O. Reg. 462/24).
AND THIS MATTER having come before the Tribunal by way of the City of Toronto’s request for scoping, on consent of the Appellant;
AND THE TRIBUNAL having received the correspondence of the Appellant dated September 4, 2025, and October 3, 2025, and the written submissions of counsel for the City of Toronto pertaining to the scope of the Appeal of ZBA 849-2025;
THE TRIBUNAL ORDERS that:
The scope of the Appeal includes only the following property: 42 Donalda Crescent (the “Property”).
ZBA 849-2025 is deemed to have come into force and effect, in full and unamended, for the entirety of the City of Toronto, excluding the Property, as of the day it was passed, being July 24, 2025, pursuant to subsection 34(31) of the Planning Act, R.S.O. 1990, c. P.13, as amended.
The Appeal of ZBA 849-2025 is adjourned sine die.
