MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON OCTOBER 7, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This was the second Case Management Conference (“CMC”) in the matter of appeal by Starbank Developments 1416 Corp., arising from the failure of the City of Toronto to make a decision on the Zoning By-law Amendment, pursuant to ss. 34(11) of the Planning Act, for the property located at 1410-1416 Eglinton Avenue (“site”).
PARTY STATUS REQUEST
2In advance of the second CMC, the Tribunal received a request from the Toronto Common Elements Condominium Corporation No. 2018 (“TCECC 2018”), a townhouse community located immediately adjacent to the site, to convert from Participant to Party status, to ensure that the Tribunal has a complete picture of impacts, to be tested through evidence.
3At the second CMC, the Tribunal questioned the TCECC 2018 as to whether they intend to call any expert evidence at the Hearing. Mr. Hernandez confirmed that his client, if granted Party status, will have between one to three expert witnesses.
4The Tribunal determined that the TCECC 2018 has genuine interest in the proceedings and granted it Party status.
DRAFT PROCEDURAL ORDER, ISSUES LIST AND HEARING DATE
5Prior to the second CMC, the Tribunal received a copy of the Draft Procedural Order (“DPO”) and Issues List (“IL”). Given the additional Party and additional time for their expert witnesses, the Parties requested some time to update DPO and IL and requested 14 days for the Hearing.
6The DPO and IL are due on or before Tuesday, October 21, 2025.
7A 14-day Hearing is scheduled to proceed by video and commence on Tuesday, October 20, 2026, at 10 a.m. and continue through Friday, November 6, 2026.
