MEMORANDUM OF ORAL DECISION DELIVERED BY S. BOBKA ON OCTOBER 9, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This was the third Case Management Conference (“CMC”) for:
Appeals filed by multiple Appellants pursuant to s. 17(24) of the Planning Act (“Act”) regarding the approval of an Official Plan Amendment (“OPA”) pertaining to the interim policies of the Major Transit Station Areas; and,
Appeals filed by multiple Appellants pursuant to s. 17(36) of the Act regarding the approval of a new City Official Plan (“Brampton Plan”).
2The Tribunal was advised by letter dated September 15, 2025, that Candeco Realty Limited had formally withdrawn its appeals of these matters.
PARTY STATUS REQUESTS
3At the previous CMC, the Tribunal deferred a request for Party status to the Brampton Plan matter (OLT file no. OLT-24-000688) from 201 County Court Brampton Holdings Inc. (“Concert”), owners of the property known municipally as 201 County Court Boulevard, which is located east of Hurontario Street and north of Country Court Boulevard within the Ray Lawson Major Transit Station Area (“Ray Lawson MTSA”).
4Counsel for Concert provided an overview of their request and explained that a number of the appeals filed relate specifically to the Ray Lawson MTSA and Schedule 131, and that additional changes to the Ray Lawson MTSA may be made through the ongoing appeal process at the Tribunal. Concert is seeking party status to protect its ability to provide appropriate infill development on the Subject Lands in direct proximity to a MTSA station and to ensure that the Ray Lawson MTSA road network is appropriately studied and effectively and equitably established. Concert acknowledged its roles and obligations as a Non-Appellant Party to the Brampton Plan appeals under Rule 8.3 of the Tribunal’s Rules of Practice and Procedure, and was prepared to shelter under appeals applying to the Ray Lawson MTSA.
5Mr. Engell advised that while the City had hoped to resolve the issues raised by Concert, making the request for Party status unnecessary, that had not yet occurred. The City recognized that the Party status request had been outstanding for some time and consented to the request.
6Upon consideration, the Tribunal granted Party status to Concert as it has a direct interest and will assist the Tribunal in the adjudication of the matter.
UPDATE ON SETTLEMENT AND MEDIATION
7Mr. Engell advised that through continued mediation, the Parties had been productive and reached a number of proposed resolutions; however, it had taken longer than anticipated to get direction from City Council, and the proposed resolutions were now in circulation with the Parties. He highlighted that a draft Order, to which all Parties consented, was in the works and would hopefully be ready in the next few weeks. Once all Parties had commented and agreed, Mr. Engell proposed that the City would bring forward a Settlement Motion, and he suggested that this might be most efficiently conducted in writing. Mr. Engell explained that the motion would contain a table of outstanding matters, agreed to by all Parties, as this would clarify for the Tribunal exactly what was still under appeal. Should the Parties have difficulties agreeing to the table of outstanding matters, this could be addressed at a subsequent CMC.
CONSOLIDATION OR HEARING TOGETHER
8While the matters were joined together administratively and were heard concurrently at the CMC for the sake of efficiency, no formal ruling had yet been made as to whether these appeals should be consolidated, heard together or heard consecutively. Mr. Engell requested that this be addressed at the next CMC, as the Parties were still working to better understand the shape of the hearing process. He explained that it might not be necessary or appropriate to hear the matters together. The Tribunal agreed that this will be dealt with at the next CMC.
NEXT STEPS
9The Parties proposed that a subsequent CMC be scheduled in March 2026 to deal with the above-mentioned items. The Tribunal agreed with the Parties’ path forward and scheduled a subsequent CMC to commence on Wednesday, March 18, 2026, at 10 a.m. by Video Hearing.
