MEMORANDUM OF ORAL DECISION DELIVERED BY CARMINE TUCCI ON JULY 9, 2025 AND ORDER OF THE TRIBUNAL
1The matter before the Ontario Land Tribunal (the “Tribunal”) was with respect to the appeals of the non-decision of the City of Vaughan (the “City”) regarding an application to amend the Official Plan.
2The Application proposes to amend the Official Plan and rezone the subject lands to permit a development comprising of two (2) mixed-use 45 storey residential and commercial buildings and one (1) 43-storey residential building. The development will include a total of 1,621 dwelling units.
3City Council failed to make a decision within the statutory timeframe.
4The purpose of the Case Management Conference was to receive status updates from all Parties to organize the hearing of these appeals.
5The Tribunal received an Affidavit of Service sworn by Ali Ahmed and was marked as Exhibit 1.
6The Tribunal heard City staff are evaluating issues identified through the processing of the Applications and will be considered in the technical review of the Applications. Furthermore, staff are awaiting comments from the public and Vaughan Council and will be addressed in a comprehensive report to a future Committee of the Whole meeting.
7The Tribunal heard the Parties are evaluating an opportunity for a settlement through mediation.
8Further, the Parties are seeking a twelve (12) day hearing.
9The Tribunal hereby schedules a hearing of these appeals commencing on Monday, March 23, 2026 at 10 a.m. Twelve (12) days have been set aside.
10The Parties are requested to submit a complete and finalized Procedural Order on or before Friday, November 7, 2025.
