MEMORANDUM OF ORAL DECISION DELIVERED BY Kurtis Smith ON September 29, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The Tribunal convened the third Case Management Conference ("CMC") pertaining to the appeals filed against the City of Toronto ("City") initiated Official Plan Amendment ("OPA 778") pertaining to the Avenues Policy Framework within the City.
2The purpose of the CMC was to review the draft Procedural Order ("DPO") and Issues List ("IL") and set Merit Hearing dates. However, the Tribunal did not receive the DPO and IL by the deadline date in the Order of the second CMC. Moments prior to the CMC, the Tribunal received an update from the City regarding the status of the case.
3Mr. McKeich, counsel for the City, provided the above-mentioned update, orally. He explained that the Appellants and the City have continued to engage in without prejudice communications to further scope and reduce their issues, to be addressed at either site-specific hearings or one or more hearings to dispose of related City-wide issues. He explained that additional time is required to refine the issues and to confirm whether any additional scoping is possible, prior to finalizing the DPO.
NEXT STEPS
4The City and Appellants requested that a subsequent CMC be scheduled for December 2025 or January 2026. The City communicated that additional time would allow the City and Appellants to continue to engage in further without prejudice communications to refine the issues and confirm whether any additional scoping is necessary prior to finalizing the DPO and IL, and fixing hearing dates.
5The Tribunal cautiously scheduled a fourth CMC and imposed a deadline to submit the DPO and IL to the Case Coordinator by 4 p.m. on Monday, January 5, 2026. In the event the deadline is not met, the fourth CMC will be adjourned and the Parties will be required to request the scheduling of a future CMC.
6The fourth CMC is scheduled to proceed by video on Friday, January 16, 2026, at 10 a.m.

ORDER
11THE TRIBUNAL ORDERS that:
a. a fourth Case Management Conference is scheduled, as set out above; and
b. the City will provide the draft Procedural Order and Issues List to the Tribunal on or before 4 p.m. on Monday, January 5, 2026.
12The Member is not seized, but may be contacted through the Case Coordinator should procedural issues arise.
