MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON SEPTEMBER 24, 2025 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) in the matter of appeals by FNF Enterprises Inc. (“Applicant” / “Appellant”) seeking the issuance of the by-law without the holding provision, pursuant to ss. 34(19) of the Planning Act, for the properties located at 229, 235, 239 and 247 Royal Oak Road in the City of Cambridge.
2The Appellant is seeking to permit two industrial warehouse buildings.
3The Tribunal received the Affidavit of Service and marked it as Exhibit 1.
MEDIATION
4The Parties informed the Tribunal that they attended a Tribunal-led mediation assessment. However, at this time, the Parties agreed to pause on scheduling formal mediation sessions with potential to resume it, if their discussions to potentially settle the issues are not successful.
CMC, PROCEDURAL ORDER AND ISSUES LIST
5The Parties are currently discussing potential issues and requested some time before providing the Tribunal with the Draft Procedural Order (“DPO”) and Issues List (“IL”), and have requested a second CMC to be scheduled later this year.
6The DPO and IL are due on or before Monday, November 3, 2025.
7The second CMC is scheduled to take place on Monday, November 3, 2025 at 10 a.m.
