THESE MATTERS, having come before the Tribunal as a written hearing to consider a settlement reached between Rongmin Li and Mankit Chan; Weihong Yang; Broadway Area Resident’s Association; and Salar Hiedar Damghani (collectively, “Appellants”) and the City of Toronto (“City”) in respect of the form and content of an Official Plan Amendment in respect of the property located at 389, 391 and 393 Broadway Avenue;
AND THE TRIBUNAL having received materials in support of proposed revisions to Official Plan Amendment No. 770 to the City of Toronto Official Plan (“OPA 770”);
AND THE TRIBUNAL having reviewed the materials filed, including affidavit evidence from Angela Zhao, Registered Professional Planner, whom the Tribunal herein recognizes as qualified to assist in its deliberations through opinion evidence in the area of land use planning;
AND THE TRIBUNAL having accepted the uncontroverted evidence of Ms. Zhao, which provides a detailed explanation of the proposed revisions to OPA 770, the reasons for those revisions and the effects of same;
AND THE TRIBUNAL having been satisfied, based upon the opinion evidence of Ms. Zhao, that the revisions, as proposed, represent good planning in the public interest;
AND THE TRIBUNAL having been further satisfied that the revisions demonstrate appropriate regard for applicable matters of provincial interest; consistency with the Provincial Planning Statement, 2024; and alignment with the overall vision in the City’s Official Plan and the Yonge-Eglinton Secondary Plan, in that they: promote the orderly development of safe and healthy communities and support the formation of complete communities by accommodating a mix of land uses, including parks and open space, and provide adequate recreational facilities through the redesignation of certain lands to reflect their intended use as a park, protecting the space to meet long term needs;
NOW THEREFORE THE TRIBUNAL ORDERS:
- The appeal is allowed in part and Amendment No. 770 to the Official Plan for the City of Toronto is modified as set out in Attachment 1 to this Order. The Tribunal Orders that Amendment No. 770 to the Official Plan is approved as modified.

To adopt Amendment 770 to the Official Plan for the City of Toronto respecting the lands known municipally in the year 2024 as 391 Broadway Avenue.
Whereas the official plan amendment was appealed to the Ontario Land Tribunal pursuant to Section 17(24) of the Planning Act, R.S.O 1990, c. P.13, as amended;
Whereas the Ontario Land Tribunal has authority to approve this By-law; and
Whereas the Ontario Land Tribunal, by its Decision and Order issued XX, and in respect of Tribunal File No. OLT-24-001251, approved the amendments to the Official Plan for the City of Toronto with respect to the lands;
The Ontario Land Tribunal Orders:
- The attached Amendment 770 to the Official Plan is adopted pursuant to the Planning Act, as amended.

AMENDMENT NO. 770 TO THE OFFICIAL PLAN
LANDS MUNICIPALLY KNOWN IN THE YEAR 2024 AS
391 BROADWAY AVENUE
The Official Plan of the City of Toronto is amended as follows:
Map 17, Land Use Plan, is amended by re-designating the lands known municipally in the year 2023 as 391 Broadway Avenue from Neighbourhoods to Parks as shown on the attached Schedule 1.
Chapter 6, Section 21, Yonge-Eglinton Secondary Plan, Map 21-8, Parks and Open Space Network Plan, is amended by adding the lands known municipally as 391 Broadway Avenue as Existing/Approved Parks, as shown on the attached Schedule 2.
