MEMORANDUM OF ORAL DECISION DELIVERED BY A. SAUVE ON SEPTEMBER 19, 2024 AND ORDER OF THE TRIBUNAL
1This is the first Case Management Conference (“CMC”) of this matter. The Appellant brought an application to the City for permission to develop a two-storey single-family dwelling. The subject land has been identified to be of natural heritage significance in the City’s Official Plan and is located within the TRCA and the Ravines and Natural Features Protection By-law boundaries.
2The Tribunal marked the Affidavit of Service of Darlene Hornsby as Exhibit 1.
3The TRCA sought Party status, which was granted without objection. The Tribunal granted the Humber Summit Residents’ Association (“HSRA”), an incorporated entity, Participant status without objection. The HSRA represents neighbours of this proposed development.
4The Parties were made aware of Tribunal led mediation and will contact the Case Coordinator if they wish to pursue that avenue.
5A draft Procedural Order (“PO”) was submitted to the Tribunal prior to the CMC. However, with the addition of another Party, the Parties sought to re-submit a draft PO once they have had an opportunity to confer with each other. A revised draft PO has been submitted and is approved to govern the upcoming hearing. The draft PO is attached as Attachment 1 to this Decision.
6The Parties believe a 15-day hearing will be necessary. The Parties believe that the hearing will hear from about 13 witnesses. The Parties will attempt to scope the issues list and will contact the Tribunal if some of the dates can be released.
7The Tribunal was able to secure a 15-day hearing commencing Monday, July 28, 2025 – Monday, August 18, 2025 (the Tribunal is not sitting Monday, August 4, 2025) at 10 a.m. by Video Hearing.

(b) the Procedural Order appended as Attachment 1 shall govern the conduct of this proceeding.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
