THIS MATTER having come before the Tribunal for a Case Management Conference on July 30, 2024 regarding the lands municipally know as 856-866 Eglinton Avenue East in the City of Toronto, with the Decision of the Tribunal having been issued on August 21, 2024 (“August Decision”);
AND THE TRIBUNAL having now been advised that the Parties, on consent, request an Order of the Tribunal, in accordance with the Procedural Order issued as part of the August Decision, to allow the Claimants to file a second Fresh as Amended Notice of Arbitration and Statement of Claim;
THE TRIBUNAL ORDERS that the Notice of Arbitration and Statement of Claim be amended in the form that is attached as Schedule A;
AND THE TRIBUNAL ORDERS that the Respondent shall be at leave to file a second Amended Reply to respond to the amendments to the second Fresh as Amended Notice of Arbitration and Statement of Claim within 30 days of this Order.
