THIS MATTER having come before the Tribunal;
AND THE TRIBUNAL having received a motion from the Corporation of the Town of Caledon pursuant to s. 34(31) of the Planning Act providing that By-law 2024-50, By-law 2024-51, By-law 2024-53, By-law 2024-54, By-law 2024-58, and By-law 2024-60 are deemed to have come into force on the day they were passed for the lands not at issue in the Appeals, which are located outside of the Ministry of Transportation’s (“MTO”) Highway 413 Focused Analysis Area (“FAA”) and the Ministry of Energy and Electrification’s (“ENERGY”) Northwest GTA Transmission Corridor Identification Study’s Narrowed Area of Interest (“NAI”) as more particularly depicted on Exhibits “F-1”, “F-2”, “F-3”, “F-4”, “F-5”, and “F-6” to the Affidavit of Alexandra Whyte sworn September 11, 2024;
THE TRIBUNAL ORDERS that By-law 2024-50, By-law 2024-51, By-law 2024-53, By-law 2024-54, By-law 2024-58, and By-law 2024-60 are deemed to have come into force on June 25, 2024 for all areas of the Town to which they apply, save and except for those areas identified as:
a. “Highway 413’s Focused Analysis Area”; and,
b. “Northwest GTA Transmission Corridor’s Narrowed Area of Interest”,
on the Schedules attached as Exhibits “F-1”, “F-2”, “F-3”, “F-4”, “F-5”, and “F-6” to the Affidavit of Alexandra Whyte sworn September 11, 2024 which remain under appeal.
