THIS APPEAL having come on for a public hearing on January 10, 2024, the Ontario Land Tribunal (the “Tribunal”) having heard opinion evidence in the area of land use planning that day that the appeals by Betovan Construction Limited (the “Appellant”) under subsection 34(11) of the Planning Act (the “Appeal”) should be allowed, in part, and the Tribunal having issued a Memorandum of Oral Decision and Interim Order on February 4, 2024, approving the zoning by-law in principle and directing the Parties to advise that the zoning by-law amendment is in final form.
THE TRIBUNAL HEREBY ORDERS that:
The Appeal is allowed, in part; and
The Zoning By-law Amendment attached to this Order as Schedule A is hereby approved.
