THIS MATTER having come on for a public hearing on October 4, 5, and 6 with a written decision issued on December 29, 2023;
AND THE TRIBUNAL having heard the evidence of all witnesses and submissions of counsel for the Parties related to the approval of the zoning by-law amendment with respect to the lands known municipally as 30 South Edgeware Road in the City of St. Thomas (the “Instrument”);
THE TRIBUNAL ORDERS:
(a) That in accordance with subsection 34(26)(b) of the Planning Act, the appeal of the zoning by-law amendment is allowed. The City of St. Thomas is directed to amend By-law 50-58 on a site-specific basis for 30 South Edgeware Road in accordance with the draft Zoning By-law Amendment attached hereto as Schedule 1 to this Order;
AND THE TRIBUNAL FURTHER ORDERS that this concludes the appeal of JEG Home Solutions Inc.
