WHEREAS Langmaid’s Island Corp. (“LIC”) and Mitchell Fasken (“Fasken”) have each appealed the Township of Lake of Bays (the “Township”) Community Planning Permit By-law 2021-11 (the “CPPBL”);
AND WHEREAS a merit hearing before the Ontario Land Tribunal (the “Tribunal”) has been scheduled to commence on March 25, 2024 (the “Hearing”) to consider the CPPBL appeals;
AND WHEREAS LIC has properly filed a Notice of Motion requesting that the LIC appeal of the CPPBL be separated from the Hearing and be considered at a future Tribunal hearing (the “Request”);
AND WHEREAS Fasken and the Township (the “Township”) have both consented to the Request;
THE TRIBUNAL ORDERS that the LIC appeal of the CPPBL is separated from the Hearing and shall be considered at a future Tribunal Hearing;
AND THE TRIBUNAL FURTHER ORDERS that it may be spoken to in the event any matter or matters should arise in connection with the implementation of this Order.
