THE APPEAL of the zoning by-law amendment application (the “Rezoning Appeal”), filed by Timbercreek 4340 Bloor St. Inc., in respect of the lands known municipally as 4340 Bloor Street West (the “Lands”), having come on for a public hearing by video conference on June 5, 2023;
AND WHEREAS the Tribunal, by way of a decision issued on October 6, 2023 (the “Decision”), allowed the Rezoning Appeal in part and approved zoning amendments in principle for the Lands, on an interim basis, with its Final Order withheld pending confirmation in writing from the City Solicitor of certain pre-requisite matters;
AND THE TRIBUNAL having now received and approved the final form of the Zoning By-law Amendment;
AND THE TRIBUNAL having been advised that all of the pre-requisite matters set out in the Decision have been satisfactorily addressed;
AND THE TRIBUNAL being satisfied that its direction as set out in the Decision has been met;
The Tribunal orders that, having previously allowed the appeal, in part, the City of Toronto Zoning By-law 569-2013, as amended, is hereby amended in the manner set out in Attachment “1” to this Final Order;
AND THE TRIBUNAL authorizes the municipal clerk to format, as may be necessary, and assign a number to these by-laws for record keeping purposes.
