THIS MATTER having come before the Tribunal as a settlement in writing and upon reviewing the affidavit evidence of Allan Ramsay RPP, and the submissions of Dennis Perlin, Assistant Town Solicitor for the Town of Oakville, the Tribunal has considered the application which has been amended from the original application, and the Tribunal has determined as provided for in subsection 45(18.1.1) of the Planning Act that no further notice is required,
THE TRIBUNAL ORDERS that the Appeal of The Town of Oakville is allowed in part, and the following variance to By-law No. 2014-14 is authorized subject to the conditions set out in Attachment 1 to this Order.
- To permit the maximum residential floor area ratio for the detached dwelling to be 44.54% (315.70 m2)

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.

Conditions:
That the proposed new dwelling be constructed in general accordance with the Revised Site Plan and Drawings (Elevations and Floorplans) dated April 12, 2024, attached as Exhibit 13 to the Affidavit, on file with the Tribunal; and
That any approval expires two (2) years from the date of the OLT Decision if a building permit has not been issued for the proposed construction.
