MEMORANDUM OF ORAL DECISION DELIVERED BY A. MASON ON JANUARY 22, 2024 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This first Case Management Conference (“CMC”) was held in respect of appeals concerning the failure of the City of Toronto (“City”) to make a decision within the statutory timeframes pursuant to Section 34(11) of the Planning Act and Section 114(15) of the City of Toronto Act, 2006 in respect of the property known as 1 York Gate Boulevard, City of Toronto (“Subject Property”). The Applications were filed by 7506473 CANADA INC. (“Appellant”) to facilitate the development of a 22-storey purpose-built residential apartment building on the northwest portion of the Subject Property.
NOTICE
2An Affidavit of Service sworn on November 30, 2024, attesting to the giving of notice for this proceeding, was marked as Exhibit 1.
REQUESTS FOR STATUS
3No requests for Party or Participant status were received by the Tribunal for this matter.
MEDIATION
4The Parties advised that they are actively in discussions with a view to scoping or resolving various issues. The Parties are aware of Tribunal-led mediation and will request same if desired.
SECOND CASE MANAGEMENT CONFERENCE
5At the request of the Parties, the Tribunal scheduled a second CMC to advise on the status of settlement discussions and to provide a draft Procedural Order (“PO”) and Issues List (“IL”). The Tribunal scheduled a second CMC on Monday, May 6, 2024, at 10 a.m. by Video Hearing.

Questions prior to the hearing event may be directed to the Tribunal’s Case Coordinator having carriage of this case.
10The Tribunal directed the Parties to provide a draft PO and IL in advance of the second CMC by Wednesday, May 1, 2024.
ORDER
11The Tribunal orders that a second Case Management Conference shall be held on Monday, May 6, 2024, at 10 a.m. by Video Hearing.
12The Tribunal directs the Parties to submit a draft Procedural Order and Issues List for the second CMC by Wednesday, May 1, 2024.
13No further notice is required.
14The Panel is not seized of this matter.
