THIS MATTER having come on for a status hearing held by telephone conference call on January 25, 2024 (“TCC”) further to the Tribunal’s Decision issued December 21, 2023, which scheduled a case management conference and motion hearing for March 1, 2024;
AND THE TRIBUNAL having been advised that the City of Mississauga intends to bring a motion seeking to strike certain issues of Dunpar Homes from the draft issues list in the current draft Procedural Order under discussion by the Parties;
AND THE TRIBUNAL after considering all submissions of the Parties made at the TCC concerning the matters of continuing disagreement and the intended motion of the City of Mississauga;
THE TRIBUNAL THEREFORE ORDERS THAT:
The City of Mississauga shall commence its intended motion as soon as possible pursuant to Rule 10 of the Tribunal’s Rules of Practice & Procedure (“Rule 10”);
The Parties shall follow the procedures set out in Rule 10 and shall deliver all motion records, responding motion records, factums, reply submissions and briefs of authorities to the Tribunal, in bookmarked PDF format, by no later than February 28, 2024
The intended motion by the City of Mississauga shall be heard by the Tribunal on March 1, 2024. On the same date, the Tribunal shall also conduct a Case Management Conference and the Parties shall advise the Tribunal of their views on a hearing date for this proceeding at that time; and
This Vice Chair shall remain seized with respect to the motion filed by the City of Mississauga returnable March 1, 2024 and the Case Management Conference as described in paragraph 3 of this Order.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”).
