MEMORANDUM OF ORAL DECISION DELIVERED BY WILLIAM MIDDLETON AND MATHIEU QUESNEL ON JUNE 6, 2024 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This Decision arises from a Case Management Conference (“CMC”) held on June 6, 2024.
2This proceeding arises from an expropriation by Metrolinx on November 25, 2022, of lands owned by the Claimant located at 356 Eastern Avenue in the City of Toronto.
3The Claimant commenced an action for compensation pursuant to the Expropriations Act, R.S.O. 1990, c. E.26, as set out in a Statement of Claim dated March 8, 2024. Metrolinx delivered its Reply on March 28, 2024.
4The Parties have agreed to a Procedural Order to govern this proceeding and, on consent, sought a hearing for approximately 15 days in October 2025. They also intend to seek mediation after the documentary and oral discovery processes are complete.
5The Tribunal has scheduled a 15-day Video Hearing commencing on Wednesday, October 15, 2025, at 10 a.m. and ending on Tuesday, November 4, 2025.
6Parties are asked to log in to the Video Hearing at least 15 minutes before the start of the event to test their video and audio connections:

10THE TRIBUNAL ORDERS THAT:
(a) The Hearing of this matter shall proceed as scheduled above;
(b) The Procedural Order appended as Attachment 1 to this Decision shall govern the future conduct of this proceeding.
