MEMORANDUM OF ORAL DECISION DELIVERED BY F. LAvoie ON May 21, 2024 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1On Tuesday, May 21, 2024, the Tribunal convened the third Case Management Conference (“CMC”) regarding the Appeals brought by LCG 100 Eglinton Square Ltd. (“Appellant”) for the failure of the City of Toronto to make decisions with respect to the Appellant’s Applications for an Official Plan and Zoning By-law Amendment, and for Site Plan Approval to facilitate a mixed-use development at 100 Eglinton Square.
2The day before the CMC, the Parties requested an adjournment on consent and advised the Tribunal that mediation discussions were ongoing. They also advised that more time was required to determine whether a resolution could be attained, obviating the need for a merit hearing. The Tribunal did not have enough time to consider the request to adjourn, and the third CMC was convened as scheduled.
3The Parties jointly submitted that a fourth CMC be held in September 2024, at which point they would be in a position to schedule either a settlement hearing or a merit hearing.
SCHEDULING OF THE NEXT CMC
4The fourth CMC will commence on Wednesday, September 18, 2024 at 10 a.m., by Video Hearing.

9The Tribunal orders that the fourth Case Management Conference will commence on Wednesday, September 18, 2024 at 10 a.m. by Video Hearing.
