THIS MATTER having come before the Tribunal for a public hearing on November 7, 2023 and the Tribunal, in its Decision and Interim Order issued on March 26, 2024 (the “Interim Order”), having ordered that the appeal by the Riwoche Society against Zoning By-law No. 2022-117 (the “ZBA”) for the City of Kawartha Lakes is allowed, in part;
AND THE TRIBUNAL having withheld its final approval of the ZBA until:
a) The delivery by counsel for the City of a final revised version of the ZBA reflecting all modifications ordered by the Tribunal (the “Final ZBA”); and
b) The written confirmation by counsel for the City of Kawartha Lakes and the Riwoche Society that they agree with the Final ZBA;
AND THE TRIBUNAL now being satisfied that the conditions for the release of the Tribunal’s Final Order with respect to the Final ZBA have been satisfied;
THE TRIBUNAL ORDERS that the Final ZBA attached to this Order as Attachment “1” is approved.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
